Terms and Conditions
All services over 24 miles from the Birmingham International Airport will incur garage to garage billing. Omni Transport Luxury requires a 50% retainer of total charges for all hourly services at the time of booking. All retainers are Non-Refundable. The remaining balance will be charged to the credit card, on the day of the charter/rental date. Point to Point Transfers and Airport Transfers out of the city of Birmingham will be billed as an hourly service. Point to Point Transfers and Airport Transfers will be billed twenty-four (24 ) hours prior to the scheduled pickup date. Requests for any additional stop(s) or waiting times that are not arranged at the time of booking may not be able to be accommodated. Transportation in limousines, luxury coaches and buses are considered hourly charters.
Overtime:
-Airport pickups: We monitor the flight status of all commercial flights. A thirty (30) minute grace period is allowed on all domestic arrivals and forty-five (45) minutes on all international arrivals after flight lands, after which time you will begin incurring wait-time charges. Wait-time charges will apply after the grace period and accrued in half-hour (1/2) increments, based on the vehicle’s hourly rate, STC charge and chauffeur gratuity.
-Airport Drop offs/Point to Point transfers: A fifteen (15) minute grace period is allowed. Waiting time charges will apply after the grace period and accrued in half-hour (1/2) increments, based on the vehicle’s hourly rate, STC charge and chauffeur gratuity.
-Hourly Charters: Waiting time charges will begin at the end of the scheduled drop off time. Time is accrued in half-hour (1/2) increments, based on the vehicle’s hourly rate, STC charge and chauffeur gratuity.
Cancellations:
In the event of cancellations, the following guidelines will apply.
-Charter/Hourly Services: Payments exceeding the required non-refundable retainer, if cancelled seven (7) days prior to the scheduled date, will be refunded. For any cancellations less than seven (7) days prior to the scheduled date, the card will be billed and no funds will be refunded.
-Point to Point/ Airport Transfers require a seventy two (72) hour advance notice of cancellation to receive full refund. Cancellations inside of 72 hours will be billed the total trip amount.
No double trip cancellations, if so full trip will be charged to clients.
(ie. call to schedule a trip then cancel before a cancellation fee is charged, call and reschedule the same trip and then call back and cancel for a second time.)
Transportation in limousines, luxury coaches and buses are considered hourly charters. (Large SUV's, Exotic Vehicles & Sprinters)
Omni Transport Luxury Chauffeured Service , LLC is not liable in the event of mechanical breakdown/flat tire while on road and will only be responsible for making up lost time at a mutually agreed date. The client assumes full financial liability for any damage to the vehicle caused during the duration of the rental by them or any members of their party. There is a fee of $500.00 for each carpet or seat burn. All of our vehicles are NON-Smoking. Sanitation fee is $500.00. Drug use is prohibited by law. Any fines will be paid for by the customer. The driver has the right to terminate run without refund (if there is blatant indiscretion on the part of the client(s)). Omni Transport Luxury reserves the right to cancel any reservation before, during or after, any act of God such as; but not limited to, (Tornados, Thunderstorms, Ice, Snow, Earthquakes, Floods, Epidemic or Pandemic). Omni Transport Luxury Chauffeured Service, LLC is Not responsible for articles left in the vehicle. Vehicles cannot be loaded beyond seating capacity. A cleaning fee will be billed to the account of $350.00 if vehicle for excessive mud. sand etc.
WARRANTY: Vendor warrants that the limousine has undergone regular maintenance and is in good, clean condition. The foregoing warranty does not warrant that the limousine will be free from unforeseen mechanical defects. ASSUMPTION OF RISK BY CUSTOMER Vendor does not assume any responsibility for any personal articles or items lost, stolen, damaged or left in the limousine. Vendor is not responsible for delays in the limousine’s departure and arrival caused by weather, road conditions, hazards, accidents or other unforeseen events, including acts of God or War.
RULES & SPECIAL CONDITIONS: Customers and not more than scheduled number of persons shall be provided transport or shelter in the limousine.
REFUNDS: Omni Transport Luxury does not provide any cash refunds, if a refund is necessary it will be given in an Omni gift certificate, if clients cancel reservations not due to an act of God or cancellation of an event by promoters, hosts etc. A full refund in the method payment was received will be issued if ONLY cancellation occurs due to an act of God or the event being canceled by the promoters or host. Any acts of God or cancellations that could occur on the day of the event outside of the client's control, meaning the event canceled by the promoters, acts of God etc. will relieve a party from performing its contractual obligations when an unexpected external event has occurred which prevents it from performing.
The following activities are prohibited in or within one hundred (100) feet of the limousine: • Consumption of alcoholic beverages (by a minor) • Consumption of illegal drugs • Smoking • Violent or unruly behavior. • Conduct causing, or in driver’s opinion likely to cause, damage to the limousine. • Conduct interfering with, or in driver’s opinion likely to interfere with, safe operation of the limousine. • Vendor expressly reserves the right to terminate or cancel service without any refund whatsoever if the driver observes violation of the rules as stated above.
DAMAGE: Customer agrees to pay for any and all damage and any cleaning to the limousine which results or is required due to the conduct of any person in the limousine. Specifically, such damage includes, but is not limited to, burns, spillage, vomiting, broken glassware, scratches, stains and broken windows, seats, and mirrors. Customer agrees that the charges for such repairs and cleaning will be assessed to the individual or entity who has rented the limousine. Customer agrees to remit payment for damages within seven (7) days of the date of the event.
JURISDICTION: The parties agree that all the terms and conditions stated herein shall be construed under the laws of the State of Alabama and any action or proceeding brought in connection with or arising out of this contract shall be within the jurisdiction of the Jefferson County District. Customer agrees to indemnify the driver and Vendor for any and all costs and fees incurred in the defense of any claim made against them arising out of and in connection with the rental of the limousine.
